"Phase No. 1" is the plat's own label — the name itself plans for more.

Seventeen homes, one year, one shape

Covenants: recorded, in force, and easy to miss

This site reads covenants from the recorded documents before repeating anything about them. Pebble Creek has them. On September 22, 2025, Pebble Creek Property Fund LLC recorded a 42-page Declaration of Covenants, Conditions and Restrictions (instrument 470150). Its Exhibit A binds “All of Pebble Creek – Phase No. 1”, meaning every lot, and section 13.3 says the covenants run with and bind the project in perpetuity. No amendment has been recorded as of September 2026.

It is worth knowing how nearly invisible this document is. It is filed under the type “Declaration” rather than “Covenants”, its description field in the county index is blank, and it is indexed to Pebble Creek Property Fund LLC rather than to Bench Farms LLLP, the company named on the plat. A buyer who reads the plat and stops there, or who searches the recorder the obvious way, will conclude there is no association here and will be wrong. The plat's own owner's certificate says nothing about covenants; the declaration arrived two and a half years later.

What the recorded text establishes:

  • There is an association. Pebble Creek Property Owners Association, Inc., an Idaho nonprofit corporation. It owns the common areas and is responsible for snow removal, irrigation, and each unit's roof and siding. Owners handle the rest, down to sweeping their own patios and entryways.
  • There are dues, and they are enforceable. Each unit pays an equal share of an annual budget the board adopts without an owner vote. Assessments fall delinquent after five days, carry interest, and are secured by a lien the association can foreclose. Each buyer also pays a non-refundable working-capital deposit equal to two monthly assessments, plus a transfer fee the board sets. The recorded document names no dollar amount, so this page quotes none. Ask the association and the title company for the current figure, the budget and the reserve balance.
  • Renting is limited. You may not lease less than the entire unit, and no lease may run shorter than 30 days unless the board has approved that specific unit as a short-term rental in advance, application and named platform included. The board may refuse simply because no short-term-rental slots are available.
  • Parking is the strict one. Cars, motor homes, recreational vehicles, boats, boat trailers, travel trailers, campers, all-terrain vehicles and mobile homes may be kept only in a designated parking area, and the board may have a violating vehicle towed without notice at the owner's expense. Unregistered or inoperable vehicles get ten days.
  • Two pets, meaning dogs, cats or household birds, without board permission for more; dogs on a leash of six feet or less outside the unit.
  • Anything visible from outside needs written board approval, including enclosing a patio or balcony, reflective window coverings, and even a “For Sale” sign. Permanent basketball hoops are prohibited outright, grills are barred from front porches, outdoor clotheslines are barred, and decorative lighting must be off between 11pm and 6am. Several rules carry named fines on a third violation.
  • The developer still runs the board. Declarant control lasts until 90 days after 90% of the units are conveyed and the developer no longer holds adjacent land. With most lots still unbuilt, that has not happened.
  • Changing the rules takes 67% of the votes in the association, and the developer may amend alone while declarant control lasts.

Because these are attached townhomes, the declaration sets no minimum square footage, roof, siding, fence or setback rules. The association owns and maintains the exteriors, so those questions never arise.
